Use of the site
Acceptance of terms
By accessing or using 91game.io (the "Site"), you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms of Service in full. If you do not agree to these terms, you must discontinue use of the Site immediately.
Permitted use
You may access and use the Site solely for lawful, personal, and non-commercial purposes. You agree not to attempt unauthorised access to any part of the Site or its servers, introduce viruses or disruptive code, scrape content by automated means without our written consent, impersonate any person or entity, or otherwise interfere with the Site's integrity or performance. Violations may result in immediate account suspension and, where warranted, referral to the relevant law enforcement authorities in India.
Account responsibilities
If you create an account on 91 Game, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorised use. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect are being used fraudulently.
Intellectual property
Ownership of content
All content available on 91game.io, including text, graphics, logos, icons, images, audio clips, game assets, and software, is the exclusive property of 91 Game or its licensors and is protected under applicable Indian and international intellectual property laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999.
Licence to users
Subject to your compliance with these Terms, 91 Game grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for your personal, non-commercial enjoyment. This licence does not include any right to reproduce, distribute, or create derivative works from Site content, reverse engineer any software forming part of the Site, remove proprietary rights notices, or use any 91 Game trademarks or logos without our prior written consent.
User-submitted content
If you submit any content to the Site, including reviews, comments, or feedback, you grant 91 Game a worldwide, royalty-free, perpetual licence to use, reproduce, modify, and distribute such content in connection with operating and promoting the Site. You represent that you own or have the necessary rights to grant this licence and that your content does not infringe any third-party intellectual property rights.
Limitation of liability
No warranties
The Site and all content, features, and services provided through 91game.io are offered on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 91 Game does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Liability cap
To the fullest extent permitted under the Information Technology Act, 2000 and other applicable Indian law, 91 Game, its directors, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid to 91 Game, if any, in the twelve months preceding the event giving rise to the claim.
Third-party services
The Site may integrate with or link to third-party platforms and payment processors, including PhonePe, Google Pay (GPay), and BHIM UPI. 91 Game is not responsible for the availability, accuracy, or practices of any such third-party service. Transactions conducted through those platforms are governed solely by the respective provider's terms and policies, and any related disputes must be directed to them.
Governing law
Applicable law and jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India for the resolution of any such dispute. If you access the Site from outside India, you remain solely responsible for compliance with any local laws applicable in your jurisdiction.
Dispute resolution
Before initiating formal legal proceedings, both parties agree to attempt in good faith to resolve any dispute informally by contacting 91 Game at [email protected]. We will endeavour to respond within 15 business days. If the dispute is not resolved within 30 days, either party may pursue remedies through the competent courts described above, or through arbitration under the Arbitration and Conciliation Act, 1996, as mutually agreed in writing.
